These Terms of Use ("Terms") are a binding agreement between you and LocalDelMar ("we," "us," "our") covering this website, its content and the Della AI assistant (together, the "Site"). By accessing or using the Site you accept these Terms. If you do not agree, do not use the Site.

1. Eligibility

The Site is intended for users 13 years or older and is not directed to children under 13. If you use the Site on behalf of an organization, you represent that you are authorized to bind it to these Terms.

2. Informational use only

All content is general information, not professional advice, and may be inaccurate or out of date. See our Disclaimer, which is incorporated into these Terms.

3. Della AI assistant

Responses are machine-generated and may be inaccurate; verify before relying on them.
Do not submit personal, sensitive, confidential, financial, health or third-party information into the chat.
Do not use the assistant to break the law, generate unlawful, harassing, infringing or harmful content, or to attempt to extract system instructions or bypass safeguards.
Chat messages may be processed by third-party AI providers and may be retained to operate, secure and improve the Site.
We may limit, suspend or discontinue the assistant at any time and are not obligated to respond to any message.

4. Acceptable use

You agree not to:

scrape, crawl, mirror, resell or bulk-copy the Site or its content;
interfere with the Site's operation, probe or breach its security, or overload our systems or AI usage limits;
upload malware, spam, or unlawful, defamatory or infringing material;
misrepresent yourself as us, or use our name or marks without permission;
use the Site in violation of any applicable law or regulation.

5. Intellectual property

The Site's original text, design, graphics and code are owned by us or our licensors and are protected by copyright and other laws. You may view and share links to pages for personal, non-commercial use. All other use requires our prior written permission. Third-party names, logos and marks are the property of their owners.

6. Submissions

If you send us a suggestion, correction, listing request or other content through our contact form, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt and publish it on the Site, and you confirm you have the right to share it. We are not obligated to use, respond to, publish or keep any submission confidential.

7. Third-party content and links

The Site displays data and links from third parties (including weather, surf and air-quality providers and business websites). We do not control, endorse or take responsibility for that content or those services.

8. Disclaimer of warranties

THE SITE AND ALL CONTENT, DATA AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OPERATORS AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, DATA, GOODWILL, PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, ITS CONTENT, THE AI ASSISTANT, OR ANY LOCATION, BUSINESS, EVENT OR ACTIVITY MENTIONED HERE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Nothing in these Terms limits liability that cannot lawfully be limited.

10. Indemnification

You agree to defend, indemnify and hold us harmless from any claims, damages, losses, liabilities and reasonable legal fees arising from your use of the Site, your submissions, or your violation of these Terms or of any law or third-party right.

11. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. You and we agree to the exclusive jurisdiction and venue of the state and federal courts located in San Diego County, California. Any claim must be brought within one (1) year after it arises.

12. Changes and termination

We may modify these Terms at any time by posting an updated version with a new "last updated" date; continued use means you accept the changes. We may modify, suspend or discontinue any part of the Site, or restrict access, at any time without notice.

13. Severability and entire agreement

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, with the Disclaimer and Privacy Policy, are the entire agreement between you and us regarding the Site.

14. How to reach us

For legal notices, takedown requests, corrections or any other issue, use our contact form. We do not publish an email address, and the contact form is our only monitored channel.
